ADVERTISEMENT FOR BIDS

            The Town of Bolton invites bids in connection with The Town of Bolton DPW Garage Roof Replacement located on 87 Finkle Rd Bolton Landing NY 12814 in accordance with bidding documents prepared by Chazen/LaBella Associates, D.P.C. with offices located at 4 British American Blvd Latham NY 12110

Bid is requested for the prime contract:

Contract 1:       General Construction (GC)

Sealed bids (in duplicate) will be received by the Director of Planning & Zoning, at the Town Office, located at 4949 Lake Shore Dr Bolton Landing NY 12814 at 3:00p.m. Local time on September 23, 2021 at which time they will be publicly opened and read aloud.

Documents will be released for bid on August 16, 2021. There will be no pre-bid conference scheduled for this project.

Drawings and Specifications will be available for pick up August 16, 2021 at Dataflow; 2215 Central Ave, Schenectady, NY 12304 upon receipt of a bid deposit of Fifty Dollars ($50.00) for each set of documents requested. Checks shall be made payable to Town of Bolton.

Bid documents, if requested, will be mailed to Bidders upon receipt of deposit and reimbursement for the cost of mailing. Mailing fee for one set is $35.00 for UPS delivery. Check shall be payable to Town of Bolton.

Digital viewing will be available – Bidders may register to view the CONTRACT DOCUMENTS, online free of charge, on our project portal through the following option: by visiting www.godataflow.com ; click “Find Projects”, click “register Now” to obtain a valid username and password.

A pre-bid meeting or walk thru will not be held at this time. A Bidder whose bid is accompanied by a certified check or other security in accordance with the bidding requirements and public advertisement and who returns a complete set of Bidding Documents in good condition within thirty (30) days following the award of the contract covered by such Bidding Documents, or the rejection of such bid, shall receive a refund of the full amount of the deposit for one (1) copy of the Bidding Documents.  Partial reimbursement in an amount equal to the deposit for one (1) set of Bidding Documents, less the actual cost of reproduction of the Bidding Documents, shall be made for the return of all other copies of the Bidding Documents in good condition after thirty (30) days following the award of the contract or the rejection of the bids covered by such Bidding Documents. Bidders should return sets to Attn: Plan and Print.

Prospective subcontractors and material suppliers may obtain Bidding Documents they require by payment of printing and mailing costs.

Attention of the Bidder is particularly called to the Owner’s sales tax exemption, the requirements as to conditions of employment to be observed and the minimum wage rates to be paid under the contract. In addition, the Bidding Documents for this project contain detailed requirements for the qualification of Bidders.  These include, among other things, rigid bonding and insurance requirements, financial statements, bank references, lists of lawsuits, arbitrations or other proceedings in which the Bidder has been named as a party, a statement of surety’s intent to issue Performance and Payment Bonds, and a description of other projects of similar size and scope completed by the Bidder.

            Bids shall be prepared as set forth in “Instructions to Bidders”, enclosed in a sealed envelope bearing on its face the name and address of the Bidder and the title of the Work to which the bid enclosed relates.

Each Bidder shall deposit with its bid, security in an amount not less than five percent (5%) of the base bid in the form and subject to the conditions provided in the “Instructions to Bidders.”

No Bidder may withdraw his bid within forty-five (45) days after the actual bid opening.

The Town of Bolton reserves the right to waive any and all informalities in or to reject any or all bids.

The Owner further reserves its right to disqualify Bidders for any material failure to comply with the “Instructions to Bidders” and “Supplementary Instructions to Bidders.”

NOTICE OF RESOLUTION SUBJECT TO PERMISSIVE REFERENDUM
LOCAL LAW #3 OF 2021

NOTICE IS HEREBY GIVEN that at a regular meeting held on the 7th day of September, 2021, the Town Board of the Town of Bolton, New York duly adopted a resolution which is subject to a permissive referendum pursuant to Town Law

PROVIDING FOR a Local Law wherein the Town of Bolton shall “OPT OUT” of certain provisions of CHAPTER 7-A OF STATE STATUTE entitled CANNABIS LAW (also known as the NEW YORK MARIHUANA REGULATION AND TAXATION ACT, hereinafter “ACT”)

BE IT ENACTED:

That the State of New York having enacted CHAPTER 7-A of the New York State Consolidated Laws entitled CANNIBIS LAW and such legislation also being known as the New York Marihuana Regulation and Taxation Act (hereinafter “ACT”) and within such “ACT” it is authorized therein in ARTICLE 6 GENERAL PROVISIONS, Section 131 a provision for “Local Opt-Out; municipal control and pre-emption” and after a public hearing and upon due deliberation of the matter it is hereby determined by the Town Board that it is in the best interests of the community at large and within all areas of the Town of Bolton, Warren County that:

  1. a) The Town of Bolton to the fullest extent authorized  by the “ACT” and as otherwise permitted by state law hereby “opts out” from the provisions of the “ACT” that would allow the licensure and establishment of a retail dispensary license and/or on site consumption license under provisions of ARTICLE FOUR of the ACT authorizing the retail sale of adult use cannabis to cannabis consumers and by virtue of this town wide “opt out” such licensing and attendant privileges of licensing as afforded by the “ACT” shall not be applicable to the Town of Bolton at any time after the effective date of the “ACT”.
  2. b) It is further provided that upon adoption of this Local Law that the New York State Cannabis Control Board shall prohibit in the Town of Bolton, Warren County, the establishment within the Town of Bolton, Warren County, New York all cannabis retail dispensary licenses and all on site cannabis consumption licenses as specified in

ARTICLE FOUR of the ACT in all places within the geographical jurisdiction of the Town of Bolton, Warren County.

Upon the adoption of this LOCAL LAW # 3 of 2021 by the Town Board such local legislation and the enactment hereof shall be subject to a permissive referendum as governed by state statute and in particular as provided in New York State Municipal Home Rule Law.

 Warren County is in the process of developing a registry for full and part-time residents that may need additional assistance during an emergency for use by local emergency responders.  Those who choose to share the information will be asked to provide their age and address, whether they are hearing impaired, whether they have any equipment like oxygen tanks or need dialysis, or have a pacemaker or defibrillator, or medication that requires refrigeration. They are can also detail any other serious medical issues, and whether they are mobile, or need assistance to walk.  The information will also collect the names of emergency contacts.  Any information regarding language barriers may also be included.  www.warrencountyny.gov/emergency/registry/
